Our Privacy Policy aims to provide you with information about the data we collect from you, how we utilize your data, and the options available to you regarding our usage of your information. Our Privacy Policy pertains to the data we obtain from you in our physical stores, on our websites and mobile applications, and anywhere else we interact with you including our sister-brands Scandinavian Designs and Dania Furniture. Your use of any of our websites, mobile applications, or sharing of your data with us implies that you accept and agree to the procedures outlined in this Privacy Policy.

Dania Inc. supports and adheres to the guidelines and practices adopted by the California Consumer Privacy Act (CCPA), California Privacy Rights Act (CPRA), and the California Online Privacy Protection Act (CalOPPA). If you are a California, Colorado, Connecticut, Iowa, Nevada, Utah, or Virginia resident, you may have certain privacy rights under the applicable privacy laws in your state (“State Privacy Laws”). Our Privacy Policy describes those rights and how you can exercise them with our brands.

 The CCPA, CPRA, and the CalOPPA grant consumers the following rights:

  • The right to know about the personal information a business collects about them and how it is used and shared.
  • The right to delete personal information collected from them (with some exceptions).
  • The right to opt-out of the sale or sharing of their personal information.
  • The right to non-discrimination for exercising their CCPA rights.
  • The right to correct inaccurate personal information that a business has about them.
  • The right to limit the use and disclosure of sensitive personal information collected about them; and

SECTION 1: YOUR RIGHT TO KNOW

1.1 COLLECTING INFORMATION ABOUT YOU

 

"Personal information" refers to details that can identify, pertain to, describe, or reasonably be linked to you, your household, or your device, either directly or indirectly. It excludes information that's publicly available, de-identified, or grouped together. The following sections provide an overview of the personal information categories we gather and the reasons behind collecting each category of information:

  • Contact information: your first and last name, postal address, email address, and phone number.
  • Other identifying information: username and password for our websites, IP address, social media usernames, and geolocation data.
  • Financial information: credit card, debit card, and bank account information used to purchase our products.
  • Internet or other electronic activity: your browsing and click history, browser type, language, operating system, website access time, duration of visit, referring website address, browsing and search history on our websites, webpages viewed immediately before and after our websites, information related to your interactions with our websites, social media pages, emails, online chat, text message communications, and advertisements including information about how you navigate within our services and which elements of our services you use the most.
  • Commercial information: products purchased or viewed on our website, information from surveys, promotions, and product reviews.
  • Audio and visual information: videos and photos uploaded on our website and security camera recordings in our stores.
  • Communications with us: the contents of your communications with us via phone, email, text message, chat, or other means) such as survey responses, and comments on our content or social media pages.
  • Inferences from any other category of information we collect: information reflecting your preferences, characteristics, trends, or attitudes; and

1.2 CATEGORIES OF USE

 

Your information is utilized across our various platforms to enhance our services and cater to your requirements more effectively. We use your information for:

Transactional Purposes: We use your contact information, financial information, and commercial information to:

  • Receive, process, confirm, send, and track your order, subscription, or registration.
  • Communicate with you about your order, subscription, or registration; and
  • Process any subscription or registration you make to one of our services.

Analytical Purposes: We use your other identifying information, internet activity, browsing history, commercial information, and geolocation data to analyze preferences, trends, and statistics.

Marketing and Promotional Purposes: We use your contact information, commercial information, internet or other electronic activity, geolocation data, and inferences to:

  • Run contests, promotions, and sweepstakes; and

Maintenance and Improvement of Services and Website: We use your contact information, commercial information, and internet activity and browsing history to:

  • Provide and maintain functionality on our website, including our live chat or customer review features.
  • Handle your customer services requests; and
  • Help us diagnose technical and service problems and administer our stores, websites, and apps.

Review and Content Creation Purposes: We use your contact information, commercial information, and audio and visual information to enable reviews of our products and to display content that you have created and allowed us to display on our website and services and on social media.

Security and Fraud Prevention: We use your contact information, other identifying information, commercial information, financial information, internet activity and browsing history, and inferences to protect our websites, our company, and others and to prevent fraud, theft, and misconduct.

Claim Resolution: We use your contact information, commercial information, communications with us, and other identifying information in the event of a claim being filed against us to address or protect against such disputes.

1.3 SOURCES OF PERSONAL INFORMATION

 

We collect your personal information through various means, including when you directly provide information to us and when we automatically collect information about you through your use of our websites. In some instances, you may be able to choose what information to provide, but sometimes we require certain information from you to use certain features of our websites or other online services. We collect information:

From You. We collect information from you, including products purchased from us, account registration and maintenance, email subscriptions, search and chat activity on our website, contact and shipping details, financial information such as payment details, commercial information, and geolocation data when you choose to pick up online purchases in-store.

From You Automatically. We collect information from you automatically, including browsing, searching, or other interactions with our websites, opening an email, text message, or clicking on a link contained in our emails or texts, communicating with us via online chat, clicking on an online advertisement for our products, view our social media profiles and sites, post or share information about us or our products online.

From Third Parties. We collect your personal information from third parties, such as social media sites, Google, and data co-ops. We use geolocation data to create greater ease of use in our checkout, including to suggest your shipping and billing address, or to help you find the closest store location.  We may collect your identifying information from Facebook, in accordance with their terms of use and privacy policy. We purchase from and trade commercial information, and internet and electronic activity with data co-ops and other third-party data aggregators as well as other business partners, resellers, and suppliers, some of whom sell information to us.

From passive and Technical Collections. We collect internet or other electronic activity passively using tools like browser cookies. This activity is further described in the Advertising and Online Tracking section below.

1.4 COMBINING INFORMATION

 

We may combine information you give us online and in our stores. We may also combine that information with publicly available information and information we receive from or cross-reference with third parties. We use that combined information to enhance and personalize your shopping experience with us, to communicate with you directly about our products and events that may be of interest to you, and for other promotional and commercial purposes.

1.5 WHEN & HOW WE SHARE INFORMATION WITH THIRD PARTIES

 

Our Service Providers:We may contract with companies or persons to provide certain services including credit card processing, shipping, data analysis and management, promotional services, etc. We call them our Service Providers. We provide our Service Providers with the information needed for them to perform these services. We also ask our Service Providers to confirm that their privacy practices are consistent with ours.

Our Select Partners: From time to time, we might establish a business relationship with other people or entities whom we believe are trustworthy and whom we have asked to confirm that their privacy policies are consistent with ours. These are known as our Select Partners. In such cases we might rent, exchange, share and/or cross-reference information, including contact information about you that will enable such persons or entities to contact you regarding products and services that may be of interest to you. This section does not apply to mobile phone numbers and opt-in consent information collected for SMS text programs. Our brands may also collect mobile phone numbers for other purposes which are subject to this section.

Corporate Transactions: We would share your information if we engaged in a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets or if we undergo bankruptcy or liquidation.

Law Enforcement and Courts: In certain instances, we may disclose your contact information when we have reason to believe that it is necessary to identify, contact or bring legal action against persons or entities who may be causing injury to you, to our brands or to others. We may also disclose your contact information when we believe the law or legal process requires it.

Sharing Among our Entities: To enhance security and offer information on products and services that may be of interest to you, we share and merge your information among our sister-brands Scandinavian Designs and Dania Furniture. Additionally, we may share your information with our parent company, subsidiaries, joint ventures, or other companies under common control when it is required for specific purposes during our business operations.

1.6 TRACKING TECHNOLOGIES AND COOKIES

 

We use cookies and similar tracking technologies to track the activity on our service and store information. Tracking technologies are beacons, tags, and scripts to collect and track information and improve and analyze our service. The technologies we use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on your device. You can instruct Your browser to refuse all cookies or to indicate when a cookie is being sent. However, if You do not accept cookies, you may not be able to use some parts of our service. Unless you have adjusted your browser setting so that it will refuse cookies, our service may use cookies.

1.8 DO NOT TRACK SIGNALS

 

Our websites do not automatically respond to “Do Not Track” (DNT) signals sent by web browsers, mobile devices, or other mechanisms. Several third-party companies utilize cookies or beacons on their websites and enable you to opt out of this behavioral advertising. SECTION 2: YOUR RIGHT TO DELETE

You can request what personal information we have collected, used, disclosed, and sold. You can also request that we delete your personal information. We may not delete all your personal information if one of the following exceptions applies:

 

  • Transactional:to complete a transaction for which the personal information was collected, provide a good or service requested by you, or perform a contract we have with you.
  • Security:to detect data security incidents; preserve the integrity or security of systems; or investigate, report, or prosecute those responsible for any such action.
  • Error Correction:to debug or repair any errors.
  • Legal:to protect against fraud, harassment, malicious or deceptive activities, or illegal activity or to comply with applicable law or a legal obligation, or exercise rights under the law, such as the right to free speech; to assist another party with any of its obligations under applicable privacy laws; or
  • Internal Use:to use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information (i.e., to improve our services).

 

Please note that if we delete your personal information, many of our services will not work the same. Some examples include, but are not limited to:

  • Returns: We will not have the ability to look up your receipt or order in our system. To process a return or refund, we will require proof of purchase from the customer and if the customer is unable to provide proof of purchase, the transaction will be treated as an unreceipted return in accordance with our return policy.
  • Customer Service: Our ability to handle customer service requests may be limited. We will not have the ability to look up prior orders or account information and may request proof of purchase to service your needs.
  • Online Account & Shopping: Your online account will no longer exist. Your shopping cart items, order history, saved addresses, saved recipes, and any other saved preferences in your online account will no longer be available.
  • Recalls: We will no longer be able to contact you via email, regular mail, or phone about product recalls related to products you purchased, unless you provided your information to us by returning a product registration card attached to a durable infant product.
  • Marketing Communications: We will no longer be able to provide you with any marketing communications directly from our brands, including personalized marketing communication such as information about new products, services, and offers tailored to your interests.
  • Opt-Outs: Previous opt-out requests will not be saved.

To verify your identity, you will need to provide at least three of the following pieces of information: name, telephone number, e-mail address, and mailing address. We will match this information to the information on our systems. To designate an authorized agent to act on your behalf you must provide the authorized agent with written permission to do so, and your authorized agent must submit that written proof at the time they make the request on your behalf. If you wish to make multiple requests under this section, we recommend sending the deletion request last, as we will not be able to fulfill your other requests once we have deleted your information. We will maintain a record of your request to know or request to delete.

SECTION 3: YOUR RIGHT TO OPT-OUT

3.1 OPTING OUT OF MARKETING AND TRANSFERS; UPDATING INFORMATION ABOUT YOU

 

We want to communicate with you only if you want to hear from us. If you prefer not to receive direct marketing from us, or if you would like to opt out of our rental or exchange of your information with other marketers, please let us know. Please be sure to include your full name, email address, mailing address, and specifically what information you do not want to receive. If you like, you may use one of the following statements in your message to us:

  • I prefer not to receive email advertisements, such as updates regarding products and services, special promotions, or upcoming events.
  • I prefer not to receive direct mail advertisements, such as periodic catalogs and mailings regarding products and services, special promotions, or upcoming events.
  • I prefer not to have my contact information provided to third parties for their marketing purposes.

You may also click the Unsubscribe link at the bottom of all email advertisements to be removed from future email updates.

Please note that any requests to remove or update your contact information may take up to five days for your email request and 6-8 weeks to process your postal mail request.

We may need to contact you via phone, email, or mail to address questions or issues specific to your order, entry, etc., even if you have opted to not receive marketing communications from us. We contact you only in ways compatible with your communications choices. To the extent necessary for such purposes, we take reasonable steps to make sure that your contact information is accurate, complete, current, and otherwise reliable.

3.2 DO NOT SELL MY PERSONAL INFORMATION

 

We may "sell" (as sell is defined in CCPA) the following categories of personal information:

  • Identifying information.
  • Characteristics of protected classifications under California and federal law.
  • Internet/electronic activity.
  • Commercial information; and
  • Inferences drawn from the categories described above to create a profile about you to reflect your preferences, characteristics, preferences, behavior, and attitudes.

We "sell" your personal information to Select Partners and to digital advertising networks. Our platforms are accessible to all visitors, including minors, but we do not intentionally sell personal information of individuals under the age of sixteen.

 

3.3 RIGHT TO OPT OUT OF SALE

 

California, Colorado, Connecticut, Iowa, Utah, and Virginia residents have the right to opt out of the sale of your personal information to third parties.

We participate in digital advertising networks to deliver advertising that is tailored to your interests. Participation in certain ad networks can constitute a "sale" of personal information under CCPA. To opt out of this activity, please visit optout.aboutads.info and optout.networkadvertising.org.

3.4 GOOGLE ANALYTICS

 

We use Google Analytics on our websites to collect usage data, analyze how users use the websites, and provide advertisements to you on other websites. We also use it to ensure website functionality and to improve the site experience. This software may record information such as your IP address, location, browser type and language, operating system, access time, duration of visit, pages you view within our websites, search terms you enter, and other actions you take while visiting us, the pages you view immediately before and after you access our websites, how often you use our websites, aggregated usage and performance data, application errors, and debugging information. The CCPA provides consumers with a Right to non-discrimination when they exercise other privacy rights guaranteed by the law, such as the right to access, delete, or opt out of the sale of their personal information. Which means we will not treat you differently or take any retaliatory action against you if you choose to exercise your CCPA Rights. You will not be refused goods or services, charged differently, or provided with lower-quality goods or services if you choose to exercise your CCPA Rights.

SECTION 6: YOUR RIGHT TO APPEAL

If you reside in Colorado, Connecticut, or Virginia and we were unable to fulfill your request, you have the option to initiate an appeal within fourteen days of our decision. To do so, please submit an appeal request via email to hello@scandinaviandesigns.com, providing a detailed reason for your appeal along with your state of residence.

SECURITY

We take measures to ensure that the information you transmit to us is kept confidential and secure, including physical, electronic, and procedural safeguards. Our websites use Secure Sockets Layer (SSL) to encrypt your credit card details, name, and address, which makes it possible for us to decode your information. However, no data transmission over the internet can be completely secure, and we cannot guarantee or warrant the security of any information transmitted to or from our websites. Therefore, you assume any risk when transmitting information to or from our websites.

To protect your account information, please keep your password safe and do not share it with anyone. When you finish your visit, log out of your account, and close your browser window, especially if you are using a computer in a public place or sharing a computer with someone else.

CHILDREN’S INFORMATION

Our products and services are not intended for children. We do not address anyone under the age of sixteen. SOCIAL MEDIA & USER-GENERATED CONTENT

We engage with customers on various social media platforms like Google, Facebook, LinkedIn, Pinterest, and Instagram. If you contact us on one of these platforms, or through a link on our website (including link equivalents like Instagram’s Embed Code), your communications are governed by this policy and the policy of the relevant social media platform.

If you share content with us via our website or on social media channels, you are giving us permission to use, share, and store it in a manner consistent with this Privacy Policy.

 

INTERACTIVE SERVICES (CHATBOT, MANAGED CHAT, LIVE SHOWROOM, ETC.) CONSENT AND DISCLAIMERS
